1. Introduction

  1. 1.1This Privacy Policy explains how DealerLink Limited (“DealerLink”, “we”, “us”, “our”) collects, uses, discloses, stores and protects your personal information when you use the DealerLink platform (the “Platform”).
  2. 1.2We are committed to handling personal information in accordance with the New Zealand Privacy Act 2020 and the Information Privacy Principles.
  3. 1.3By registering for, accessing, or using the Platform, you acknowledge that you have read and understood this Privacy Policy.

2. Information We Collect

  1. 2.1Registration and account information you provide:
    • company name, contact name, email address and phone number;
    • business address, city and region;
    • New Zealand Business Number (NZBN) and Motor Vehicle Trader (MVTL) number;
    • your motor vehicle trader licence document and its expiry date;
    • account credentials (passwords are stored in a hashed, irreversible form).
  2. 2.2Listing and transaction information:
    • vehicle listings, photos, descriptions and pricing (including reserve prices);
    • bids, auction activity, purchases and sales;
    • seller fees and invoices.
  3. 2.3Technical and usage information collected automatically:
    • IP address, device and browser information;
    • login activity and session information;
    • pages viewed and actions taken on the Platform.
  4. 2.4We may also collect information from third parties, such as public registers, to verify your trading status and identity.

3. How We Use Your Information

  1. 3.1We use personal information to:
    • create and administer your account and verify your eligibility as a licensed trader;
    • operate the Platform — listings, auctions, bidding and transactions;
    • exchange buyer and seller contact details when a sale completes;
    • generate and manage seller fees and invoices;
    • detect, investigate and prevent fraud, misuse and prohibited conduct;
    • communicate with you about your account, auctions and service updates;
    • comply with our legal obligations.

4. Disclosure of Information

  1. 4.1When a transaction completes, we share the relevant buyer and seller contact details with each other so the sale can be settled directly.
  2. 4.2We may disclose personal information to:
    • service providers who help us operate the Platform (e.g. hosting, email and storage providers), under confidentiality obligations;
    • regulators, law enforcement or other authorities where required or permitted by law;
    • professional advisers, in connection with the operation of our business.
  3. 4.3We do not sell your personal information.

5. Storage and Security

  1. 5.1We take reasonable steps to protect personal information from loss, misuse and unauthorised access, disclosure or modification.
  2. 5.2Information may be stored on servers operated by our hosting and cloud-storage providers, which may be located in New Zealand or overseas (for example, Australia). Where information is held overseas, we take reasonable steps to ensure comparable protections apply.
  3. 5.3No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

6. Retention

  1. 6.1We retain personal information for as long as necessary to provide the Platform, to meet our legal and regulatory obligations, and to resolve disputes and enforce our agreements.
  2. 6.2Records relating to listings, bids, auctions, transactions and account activity may be retained for fraud-prevention and compliance purposes.

7. Your Rights

  1. 7.1Under the Privacy Act 2020 you have the right to request access to, and correction of, the personal information we hold about you.
  2. 7.2Some account details (such as your name, email, contact name and contact number) can only be changed through an admin-reviewed change request, to protect the integrity of verified trader accounts.
  3. 7.3To make an access or correction request, contact us using the details in section 11.

8. Cookies and Tracking

  1. 8.1We use cookies and similar technologies that are necessary to keep you signed in and to operate the Platform securely.
  2. 8.2You can control cookies through your browser settings, but disabling essential cookies may prevent the Platform from working correctly.

9. Third-Party Services

  1. 9.1The Platform relies on third-party providers for hosting, file storage and email delivery. These providers process information only as needed to deliver their services to us.
  2. 9.2This Policy does not cover the privacy practices of any third-party websites or services you may access outside the Platform.

10. Changes to This Policy

  1. 10.1We may update this Privacy Policy from time to time. The latest version will always be available on the Platform.
  2. 10.2Continued use of the Platform after an update constitutes acceptance of the revised Policy.
